Milchhaus (Service-Apartments) Am Wörth 9 at D-85354 Freising

Every owner, his relatives, the guests of the Apartment-house or the renter, form together with the other tenants a household. Every member of this household has to be interested in and has to contribute to the preservation of good coexistence based on mutual respect for tolerance. No house dweller can grow up over the inevitable extent of an orderly coexistence, disadvantages. It should be the objective to promote the community and to safeguard the preservation and maintenance of the community property. It is not intended to restrict the rights of the owners or tenants.

General:
The apartments are fully furnished and ready to move in 1-room flats and have a fully equipped stainless steel-mini-fitted kitchen, a shower bath and a community terrace at the 1st floor on the south side to the Wörth-Moosach. Access to the front door, the apartments and to the garbage chamber is provided for each user by means of specific PIN codes or access cards (also called keys), which are to unlock the locks on the corresponding doors.

Smoking is prohibited throughout the house incl. in the apartments!

1. Protection of the house from theft and vandalism

In the interest of safety, all house access doors have to be always kept closed during the day. The terrace door to the common terrace has also to be kept closed, during the day, as well. Unauthorized persons shall thereby be denied the access to the house. The garbage gate has always to be kept closed also during the day.

  1. Protection against the risk of fire

Open light and smoking endanger the property of all staircases. The apartments with their rooms and bathrooms, the corridors, the stairwells, the laundry-/drying room and the reception are not storage places for easy flammable and fire-hazardous materials and motor driven two-wheeled vehicles. The washing and handling with flammable agents in closed rooms is not allowed.

The internal corridor doors in the two staircases at the 1st floor and the top floor are always to be kept closed, because this is the only way they fulfill their fire protection purpose. This also applies to the doors to the washing- / drying room, the reception and the ground-floor cleaning room under the stairs.

  1. Protection against noise

Disturbing noise has to be avoided in the interest of all guests/residents.

The general house and night’s rest – Monday to Friday – from 12 noon to 2 p.m. and from 10 p.m. to 8 a.m., as well as the Saturday rest periods from 12 noon to 2 p.m. and from 5 p.m. to 8 a.m. are to be considered. On Sunday and public holidays, the need for residents/guests to take their rest is particularly important. During this time, all rest disturbing activities have to be avoided.

This regulation also applies in particular to the field of the public outdoor facilities, because the apartment house is located in the core of the old town of Freising. According to police regulations, all actions have to be omitted which are suitable to disturb the silence. Children are not allowed to play and make noise in the stairwell. Mutual attention is especially important when closing the doors, when using radio and television sets, music players, turntables, musical instruments, game consoles, SMART home appliances, home appliances, home improver devices, typewriters and so on. When using musical instruments, sound transmission and sound reproducing apparatus always keep room volume level.

Washing machines and dryers have not to be used after 10:00 p.m. to 8:00 a.m.

  1. Protection of community property

Each owner, guest of the apartment house as well as tenants have to be aware, that damage to the common property is a burden on all, unless replacement can be demanded from the causer. Every guest/resident should therefore endeavor in his own interest to prevent or avoid such damage. To the care of the stairwell with corridors and the common spaces (washing-/drying room, common terrace at the 1st floor) is a cleaner and if needed, an additional caretaker appointed. The insertion of these forces for the care of the common property doesn’t release the individual residents/guests from their own contributions, so that the house, the common accesses and public outdoor facilities always make a clean and well-kept impression.

  1. Protection of the apartments / cleaning and linen change appointments in the apartments

Every guest of the apartment house and also tenants have to be aware that at the hand over/return damages at the apartments and the furnishings, destructions / losses of objects / accessories and similar can be invoiced, provided that the guest/tenant is the causer. As security for this, a deposit will be charged by the guest before the start of use of the apartments. Every resident should therefore endeavor in his own interest to avoid or prevent such damage and facts. For the care of the apartments and the change of bed linen and towels is contractually regulated and included in the rent/booking price, that obligatory in a certain cycle a cleaner is used. Optionally beyond that, against payment of a fee, over the landlords a cleaner or extra linen/towels can be ordered.

Cleaning and linen change appointments in the apartments                                                                                                                                                                                            The cleaning staff has to be given access to the apartments on the day of the mandatory cleaning and/or change of linen (for example, with daily cleaning or by notice of the date on the notice board). In order to make cleaning easier for the cleaning staff and to improve the cleaning results in the apartments, and in order to protect and to maintain the property, beforehands the bathroom (for example, the sink/ the shower) and the living-/bedroom should be arranged or set freely accessible to be cleaned. All surfaces (for example, floor, sink, and kitchen with sink) and all utility places (e.g. at the bathroom mirror) with the exception of the areas with in-house decoration are here to be set freely accessible in time before the respective dates.

  1. Notification of damage

If damage to the common property occurs or damage occurs in the apartments (such as penetrating water / glass breakage on dishes or windows), report this immediately so that immediate measure can be taken to remedy or replace it.

Defects and faults in technical equipment of systems (for example, sanitary water, heating) have also to be reported immediately. In the event of imminent danger to the house, its inhabitants or third parties, each guest or tenant, as far as he is able to do this, has to provide remedy or attach suitable instructions (warning signs). If the individual homeowner or guest/tenant is not present, in the imminent danger, the operator of the apartment house, the landlord, administrator or the ordered craftsman with the assistance of a witness have the allowance to repair the damage or to operate shut-off valves, work flaps etc.; this by opening the apartment and rooms.

  1. Smoke detector

Smoke alarms are installed in the individual apartments and corridors. These should flash green every ca. 48 s, except in the night between about 9 p.m. to 7 a.m. (MEZ, winter time). A fault or an alarm can be silenced by briefly pressing the “Testtaste”. The removal or deactivation of the detector by the guest or renter is not permitted. If the detector is evidently removed or deactivated without consultation with the landlord or owner, the guest or tenant is liable for any damage caused thereby, including damage to the health and life of others. In case of permanent problems with the detector such as e.g. with unexpected, permanent or unusual warning signals without recognizable cause, please inform the landlord or owner. A battery change is not carried out by the tenant/guest, the life of the detector according to the manufacturer is at 10 years. A functional test is carried out on a regular cycle about 12 month by the landlord or owner.

  1. Keeping pets and animals

Pet keeping and keeping animals of all kinds is not allowed throughout the house. Also visitors and relatives are not allowed to carry pets along the house and the apartments.

  1. Subletting / visitors / additional guests / booking request

Subletting is not allowed. In additional, each additional guest after a booking request has to be agreed in time with the landlord/administrator and at the latest registered on the day before arrival until 11 a.m. (for example, at the front desk/telephone). A registration from is to be completed or handed over in the presence of the operator. In the event of a stay of the additional guest(s) additional charges/fees are due per additional person and apartment and night (if these fees are not regulated in a contract or in the terms and conditions, then you will receive them on request from the operator/landlord) and will be invoiced.

  1. TV connection/ internet (W-) LAN

In the condominium there is a common antenna (satellite) which in each apartment provides a Smart TV. There is therefore the possibility to use different services, e.g. Netflix at your own expense. Also, with the available LAN and also the WLAN the internet can be used. Additions or passwords to this, if not publicly posted, you get from the landlord or owner. We reserve ourselves here on the basis of the topic to the so-called “Störerhaftung” and in relation to the german “Telemediengesetzes”, if necessary to block certain Internet pages for the use. For security reasons, we also reserve the right to change the WLAN passwords/ accesses on a regular basis.

  1. Letters/ postal delivery

Letters/mail can be received by the suffix “c/o Apartment xx” at the address via the post at the entrance: àExample: Milchhaus, c/o Apartment 1, Am Wörth 9, D-85356 Freising. They are assigned to a compartment at the reception. Without specification of the apartment can’t be guaranteed that the post is correctly delivered or distributed.

12 Miscellaneous

  1. a) The entry of the technology and boiler room by unauthorized persons is prohibited. Adjustment of the heating is only allowed to trained persons.
  2. b) The removal of energy outside the apartments is not permitted. Into the gas supply and the counter in the garbage room has not to be acted. No gas has to be removed. Water from the garbage room may only be taken after consultation with the landlord or owner.
  3. c) Garbage separation has to be applied!

For the apartment house, bio and residual waste bins are available in the garbage room (accessible through your key). Similarly for the tenants/guests in the garbage room empty bio waste bags and yellow sacks/bags (e.g. plastic and plastic containers, etc.) are available. The apartments have 1 (combination) trash can, with 1 bucket side for residual waste and 1 bucket side for waste for the yellow sack/bag.

Organic waste should be added to the provided bio-waste bags and then deposited in the garbage room.                                                                                                            Yellow sacks/bags are to be deposited on top of the shelves in the garbage room, not in front of the house. In these yellow plastic sacks/bags no organic waste has to be put in/deposited!

Every tenant/guest has to dispose of the garbage in the garbage room separately (i.e., residual and bio waste and yellow sack/bag each separated).

The waste disposal statue of the city of Freising applies. The disposal calendar with the corresponding emptying dates of the relevant garbage cans and sacks is posted in the garbage room or on the notice board and should be noted. At the latest on the day before emptying, the garbage from the apartments and rooms should be introduced in the respective garbage can/barrel in the garbage room.

  1. d) To prevent clogging, house and kitchen waste, cellulose, napkins, baby diapers or liners should not be placed in the toilet or drainage basin. Determined polluters bear the costs of the cleaning and repair service.
  2. e) Bulky goods may not be deposited in the waste and garbage bins; textiles, cardboard boxes, waste paper and glass have to be returned by each tenant/guest for recycling (e.g. at the municipal building yard). These goods have not to be disposed in the house or the garbage room of the apartment house. The principle of “waste reduction through waste prevention” should always be observed.
  3. f) Carpets, clothes etc. have not to be knocked or shacked out of windows or balconies/terraces.
  4. g) Stairs, corridors are not working or storage rooms, terraces are also no storage areas. They are therefore not to be used to place or store items (bicycles/ small items of furniture/ paper/ waste/ tires, etc.). The staircases are in some circumstances to be used as a means of escape in case of fire. Ttherefore, they are not be parked with flowers and plants. Mopeds/motorcycles/ and their wheels/tires are not to be brought into the house. Bicycles not, as well.
  5. h) In the event of prolonged absence, e.g. holidays, operator, landlords or owners should be informed about the transfer of key/ cards/ PIN codes to neighbors or acquaintances; this can help in emergency situations (pipe break) quickly and possibly greater damage can be avoided.
  6. i) Barbecues and cooking with open fire, with gas or the use of electric grills/barbecues are not allowed on the common terrace and the terrace to the apartment.
  7. j) In case of pest infestation landlords or owners are to be informed immediately.
  8. k) In winter endangered facilities (radiators/water pipes running through the apartments) must be protected from freezing by suitable measures. Absence from the apartment does not release the guest/tenant from antifreeze measures. In order to ensure the heat balance in the house, adequate heating should be provided during the season, even in the absence of the resident/guest (or vacant flats). Permanently titled windows cause ventilation-related cold spots; this creates condensation water with a risk of mold growth. Therefore, short approx. 5 min. lasting rush airings across several fully open windows are preferable to be carried out.
